A referral to the Independent Examiner can be made within six months of the intimation of a decision, but only on the following grounds:
a) that fresh evidence of a material nature, as to which the Independent Examiner shall be the sole judge, has been received since intimation of the decision complained of;
b) that there is reason to suspect a lack of independence on the part of any member of the Investigation and Professional Conduct Enforcement Committee who took part in the decision complained of;
c) that the decision of the Investigation and Professional Conduct Enforcement Committee was not one which could reasonably have been arrived at upon due consideration of the facts and matters before it.
If in his opinion the Independent Examiner concludes that there is fresh evidence of a material nature that justifies such a review the Independent Examiner may accept a referral outwith the six month period.
