The appointment of the Committeeis provided for in terms of Rule 60 of Chapter XII if the Institute’s Rules.
Investigating Panel and Adjudication Committee
Members of the Investigating Panel and Adjudication Committee referred to above will be drawn from IPCEC but no individual can sit on both the Investigating Panel and the Adjudication Committee when considering the same complaint. The Investigating Panel will be formed and commence its enquiries immediately after receipt of a complaint. If the Investigating Panel considers that there is a case of professional misconduct for the Member to answer it will forward a report to the Adjudication Committee for consideration.
In the event of the Adjudicating Committee concurring that there is a case to answer the Chairman of the Adjudication Committee will write to the Member advising of the conclusion reached and of what action it proposes to take. Such action will depend on the severity of the misconduct and can range from the issue by the Committee of a warning, the issue of a Consent Order, or formal charges being remitted to the Discipline Committee for a Tribunal Hearing.
